Yes s106 - 105 was a typo error.

No I am not saying that the Council should never fight an appeal.

What I am saying is that it is highly unusual for the costs to be successfull claimed by an applicant. In fact to my own knowledge I had never heard of one prior to the Twickenham case. After 30 years in the industry I did not even know one could claim costs against a Council on a planning appeal.

The reason that costs were given against the Council was that they acted unreasonably - very unreasonably.

I am very surprised that Cllr Mann knows nothing about the Hampton Nursery appeals. It was not a local matter as it received considerable coverage in the National Press, the Estates Gazette and other property trade journals. Due to the importance of the case I would be very surprised if it was not extensively reported in the Legal press as well.

As someone purporting to be interested in Local matters , hopefully before he was elected, Cllr Mann should have had some interest and knowledge of such an important case. With out doubt the saga should be a case study for the Lib Dems Councillor training scheme.
