Notes of a meeting held on 25th September 1989 to discuss the latest position in the negotiations with LET for the redevelopment of the ice rink site and the provision of a pool/ice rink complex at Old Deer Park.
PRESENT: Councillors Williams, Razzall (Chairman) Mrs. Cornish Cornwell, Mrs Gent, Miss Hamwee and Reed.
Officers: Ms. Aldridge, Messrs. Chessman, Clyne, Harbord, Hebron, Lathan, Mellor, and Watley.
1. Current Position
1.1. Waterslides demanding £45,000 for surrender of their lease regardless of whether the LET scheme goes ahead.
1.2 Difficulties being expressed in obtaining a road closure order from DOT.
1.3 Planning enquiry due to commence 10.10.89.
1.4 Doubt exists as to whether LET have any intention of building the present pool/ice rink scheme.
2. Options for further action
2.1 Let the planning enquiry proceed and take all possible steps to win. This option was not favoured by CPO, and represents some risk as there is no guarantee LBR would win.
2.2 Negotiate a revised S.52 agreement with LET to provide for refurbishment of existing pool if Waterslides and access issues not resolved by a 'walk away' date of 31.1.90 (understood £1M on the table for further negotiation).
2.3 As 2.2 above, but with a walk away date of 30.11.89, which would be better potentially. However, this date effectively rules out the pool/ice rink complex, so is a 'compensation only' option.
3. Other Comments
3.1 Taking LET's valuation of the pool/ice rink development (£22.5M) out of the S.52 agreement eases the planning difficulties.
3.2 LET think they can build another ice rink (in Hounslow) for £6.5M but LBH deny any approaches.
3.3 The existing ice rink is breaking up fast, and would need to close at any time.
4. Agreed Course of Action
4.1 CE & DOF to phone P. Beckwith immediately with the following proposals:
a) Proceed with S.52 agreement urgently.
b) Cash payment (to be maximised by negotiation) for liquidated damages after walk away date. This compensation to be for "the enhancement of leisure and recreation facilities in the Borough".
c) Walk away date to be 30.11.89
d) LET keep the existing Ice Rink if possible, for as long as possible.
e) LBR to give planning permission at special planning committee 12.10 after P & R 10.10 have agreed S.52 proposals
f) No cash limit on value of pool/ice rink development to be imposed.
g) LET withdrawn from the planning enquiry.
4.2 The impact of any new capital controls was noted: date of receipt of compensation may be important.
4.3 Councillor Cornwell will be the sole contact with Pamela Moore.
4.4 All to be careful in communications with Pat Greenbaum (a.k.a. Professor Maclean).
