I think you mean s.106 (used to be s,52). The rule (which was observed in the ice rink case)is that the payment must be related to the planning harm done by the application.

The council has lost appeals and had to pay costs (as others have as well). Is your point that we shouldn't fight appeals we might lose (as opposed to probably will lose)? Or is that we should fight all appeals as the chance of being stung for costs is fairly low?

The most recent big application where we turned down an application against officer advice and then lost the appeal was the Kew Riverside scheme. We did not have to pay costs there. Of course we might have been made to pay them. We turned down the RFU concert application in accordance with officer advice, and the inspector ruled against us there.

The Nurserylands site was before my time and so I don't know exactly what happened.
