I do understand your point, but the transfer was of the housing stock on the basis that it was used for social housing. RTB disposals take properties out of the rented sector, and the transfer arrangements require a clawback. You could argue that RTB receipts should stay with the RHP and be used for social housing, which would have surely meant that the consideration for the transfer, which relected the clawback, would have been rather higher without it; or you could argue that the clawback is essentially a sale by instalments.

I don't believe the transfer could have been agreed at the consideration received without a clawback, but maybe you should ask this specific question of the councillors who were involved in sorting out the transfer.
