Covenants and other restrictions can be put on freeholds too - as you well know.

Secondly a residential developer could not agree to any restriction that would be unacceptable to a leasholder of the flats or his morgagee. Effectively eliminating any worthwhile covenant.

Where are these several examples in London of estates where [management] schemes have been sanctioned by the court. Yes I know about Dulwich. Have you read the Law report on the case. It is not only very imformative but the Judge was most amusing and at the same time did a first class job in difficult circumstances - the first application inder the '67 Act.

Where are the others. I think I have heard of one in North London but that is all. No scheme has been set up under the act for well over 20 years. And in any case it is not relavent to flats only housing and then in only large estates. Further more there is no incentive to the Landlord to set up these arrangements.

The Dulwich Estate [former freeholder] is one of the largest and most active charity in South East London and the surrounds. The Act robbed them of their major assit at minimal compensation. The capital paid to the Charity was based on 6% when the going interest rate was 10/12%

Yes the drafting must be carefully done. Your record is pretty bad in this direction. Secondly it is helpful if you don't lose the deed as you have done on other occassions.

The reason why I and many others , to use your own words "are causing all the fuss" is that the Council is giving away a site valued at £6m for a £1 a year

The Council removing another area of public open space from access by the public. In this case a most valuable - enviromentally area of river frontage. One of the most important assets of our borough.

You will be selling off Richmond Green next - given half the chance.
