I refer to your posting under the heading “seminar for would be councillors” dated 20th Oct. I put this reply under a new heading so I do not "hide it away" after so much correspondence on the site.

I am sorry that I have been so long in replying to you but I have had a busy week [10 days in fact] and have been unable to research the position.

You comment that I am muddling the 50% rule with the "right of first refusal" is probably correct. This was the problem I was involved in with my son. As you are a Lawyer and having looked it up I am sure you are right.

I understand that there is legislation under review to extend the leaseholders rights in this area.

However the point is academic. A long lease to a developer is a virtual freehold. [says Cllr Williams. For once I agree with him]. The freeholder has very few effective powers over what is done on a site subject to a lease of over 100 years.

In addition the residential leaseholders have a right to extend their leases. So the valuable freehold which the Council are giving away for £1 per annum will not be of any benefit to us as Council Tax payers and residents for about 6 generations at least.

In these circumstances to claim that the Council is retaining the freehold for the benefit of the community and future generations is verging on the ludicrous.
