A Planning Inspector has allowed an appeal against refusal of a change of use of the Rugby Ground to stage five concerts per year.

The permission relies upon a host of restrictive conditions the enforceability of which was questioned during the Inquiry. The thinking is that these would be enforceable because public entertainment licences also have to be granted.

Curiously, the Inspector admits that his deliberation would " ...result in "some interference with the human rights of the residents ...". He judges, however, that this has to balanced against a human right to cause a nuisance.

I dare say, therefore, that this will not mark an end to the controversy. A planning decision would presumably not, for instance, preclude an action against nuisance as a matter of common law.
